Terms and Conditions

Important Notice

Any person referred to hereunder are deemed to have accepted and agreed to be bound by the Terms and Conditions [defined in Clause 1(dd)] upon making an application or by accepting the EWP Membership or upon making an application for redemption for any of the EWP Rewards or upon participating and/or accepting any of the EWP Rewards.

Definitions

In this Terms and Conditions, unless the context otherwise requires:

  1. Alliance Bank means Alliance Bank Malaysia Berhad (Company No. 88103-W), a company incorporated in Malaysia and having a place of business at 6th Floor, Menara Multi-Purpose, Capital Square, 8 Jalan Munshi Abdullah, 50100 Kuala Lumpur.
  2. Cardholder means an EWP Participant approved and authorized by Alliance Bank to hold the EWP Card. Cardholders shall be construed accordingly
  3. Eco World means Eco World Development Group Berhad (Company No.17777-V), its related group of companies, any of its associates and affiliates.
  4. Eco World Property(ies) means any property or properties within the property development undertaken by Eco World within Malaysia with the purchase price of not less than RM400,000.00 or such purchase price as may be determined by Eco World per property and designated as property(ies) participating under the EWP.
  5. EIP means Eco World Introducer Points, the reward given in the form of reward points to EIP Participants who had successfully introduced New Purchasers to purchase Eco World Property(ies) directly from Eco World.
  6. EIP Participant means Member, New Member, Cardholder and Sub-Sale Member eligible for the EIP and EIP Participants shall be construed accordingly.
  7. EIP Recipient means the Immediate Family of the EIP Transferor who is named in the EIP Transfer Form to receive the transfer of any approved and available EIP accumulated by the EIP Transferor. n
  8. EIP Transfer Form means the approved form to be executed by the EIP Transferor and the EIP Recipient and to be submitted to Eco World for the approval of the requested transfer of any approved and available EIP accumulated by the EIP Transferor.
  9. EIP Transferor means an EIP Participant who has made a request vide the EIP Transfer Form for the transfer of any approved and available EIP accumulated by the EIP Participant to an EIP Recipient. EIP Transferors shall be construed accordingly.
  10. ELR means Eco World Loyalty Rebate which amounts to a 2% rebate of the purchase price of the sale and purchase agreement to be entered with Eco World given to ELR Participants via a credit note to offset the purchase price of the said sale and purchase agreement on any subsequent purchase of Eco World Property(ies) directly from Eco World.
  11. ELR Participant means New Member, Member and Cardholder eligible for the ELR and ELR Participant shall be construed accordingly. ELR Participants shall be construed accordingly.
  12. EWP means the Eco World Prestige Programme, an incentive and loyalty Programme operated by Eco World in recognition of the EWP Participant’s continuing support, loyalty and participation by rewarding them through the EWP Rewards.
  13. EWP Account means an account internally maintained by Eco World for the purpose of maintaining and processing records of EWP Participants in relation to the EWP.
  14. EWP Card means the Alliance Bank Eco World Debit Mastercard issued by Alliance Bank in conjunction with the EWP.
  15. EWP Membership means membership in the form of the EWP Card and/or Membership Card as may be approved and accorded to EWP Participants eligible for the EWP.
  16. EWP Participant means the ELR Participant, EIP Participant, EIP Transferor, EIP Recipient, Introduced Purchaser, and/or any other person authorised by Eco World to participate under the EWP and EWP Participants shall be construed accordingly.
  17. EWP Rewards means the ELR, the EIP and any other benefits, privileges and/or reward programmes as may be offered by Eco World under the EWP from time to time.
  18. Immediate Family means the EIP Transferor’s spouse, parents, siblings, children including legally adopted children and shall not include illegitimate children, in-laws, step parents/siblings/children, grandparents and/or grandchildren.
  19. Introduced Purchaser means a person or corporate purchaser who has made a purchase for an Eco World Property(ies) directly from Eco World by way of an introduction by an EIP Participant. Introduced Purchasers shall be construed accordingly.
  20. Member means a New Purchaser/Introduced Purchaser/New-Member who has completed the Principal SPA. For the avoidance of doubt, completion of the Principal SPA shall mean that the full purchase price stipulated therein has been fully settled. Members shall be construed accordingly.
  21. Membership Card means a membership card, as may be issued by Eco World at its absolute discretion to a New-Member and/or a Member and/or Sub-Sale Member.
  22. New-Member means a New Purchaser/Introduced Purchaser who has executed the Principal SPA and has paid ten per-cent (10%) of the purchase price stated in the Principal SPA and recommended by Eco World to be eligible under the EWP and accordingly issued with the EWP Card and/or Membership Card but pending completion of the Principal SPA. For the avoidance of doubt, pending completion of the Principal SPA shall mean that the full purchase price stipulated therein has not been fully settled. New-Members shall be construed accordingly.
  23. New Purchaser means any person and/or Introduced Purchaser who has made a purchase of an Eco World Property(ies) directly from Eco World. New Purchasers shall be construed accordingly.
  24. PDP Clause means the written notice issued by Eco World including any variation thereof pertaining to the New Purchasers/Sub-Sale Purchasers/EWP Participants’ provision of Personal Data duly acknowledged and consented by the New Purchasers/Sub-Sale Purchasers/EWP Participants to Eco World for the collection, recording, holding, storing, using, dealing with and otherwise processing such Personal Data for the purposes stated therein including any other purposes as may from time to time be notified by Eco World;
  25. Personal Data shall have the same meaning as defined by the Personal Data Protection Act 2010.
  26. Principal SPA means the first and principal stamped sale and purchase agreement in respect of a New-Member/Member’s purchase of an Eco World Property(ies) directly from Eco World.
  27. Privilege Branches means the sales offices of all participating Eco World projects.
  28. Sub-Sale Member means a Sub-Sale Purchaser who has been recommended by Eco World to be eligible under the EWP and accordingly issued with the EWP Card and/or Membership Card and Sub-Sale Members shall be construed accordingly.
  29. Sub-Sale Purchaser means a person or corporate purchaser who has acquired/purchased an Eco World Property(ies) not directly from Eco World. Sub-Sale Purchasers shall be construed accordingly.
  30. Terms and Conditions means the Terms and Conditions contained herein including any other modification, alteration, amendments, addition, deletion, variation hereto as may be determined by Eco World from time to time without prior notice at its absolute discretion governing the EWP, the EWP Membership, the EWP Rewards and the EWP Participants.

In the Terms and Conditions unless there is something in the subject or context inconsistent with such construction or unless it is otherwise expressly provided words in the singular number only shall include the plural number and vice versa.

Collaboration

In conjunction with the collaboration between Eco World and Alliance Bank, EWP membership is accorded in the form of the EWP Card which is also a privilege card that entitles the Cardholder to enjoy the EWP Rewards. This collaborative relationship shall be terminated and/or suspended at the absolute discretion of Eco World without prior notice to the EWP Participants.

The EWP Rewards offered by Eco World and the Terms and Conditions governing the EWP are separate and distinct of any benefits, privileges and/or reward programmes as may be offered by Alliance Bank together with the terms and conditions governing thereto. EWP Participants shall not hold Eco World responsible and/or accountable for the failure of obtaining the benefits and privileges promoted and/or offered by Alliance Bank notwithstanding that such benefits and privileges were promoted and/or offered by Alliance Bank in conjunction with the promotion of any Eco World Property(ies).

The EWP Card shall remain at all times the property of Alliance Bank and the Cardholders shall be bound by the terms and conditions determined by Alliance Bank in relation to the possession and usage thereof.

In the event the application for the EWP Card is rejected by Alliance Bank for any reason whatsoever, the New Purchasers and/or Sub-Sale Purchasers shall refer the matter to Eco World’s sales personnel at any Privilege Branches.

Any request for the issuance or replacement or renewal of the EWP Card for any reason whatsoever must be made directly with Alliance Bank and any cost and/or expense whatsoever and howsoever incurred and/or suffered shall be borne by the Cardholder and/or the EWP Participants, as the case may be.

Eco World shall not be responsible for any liability to damages, costs, expenses and/or losses whatsoever and howsoever incurred and/or suffered towards the success or failure of any EWP Participant in applying for the EWP Card and/or renewal of the EWP Card by the Cardholder with Alliance Bank.

The EWP is valid from 1 April 2014 until the same is terminated and/or suspended by Eco World at its absolute discretion.

Eco World may at its absolute discretion issue the Membership Card to the EWP Participants to be used under the EWP. The Membership Card when issued does not accord any benefits and/or privileges to the EWP Participants other than the EWP Rewards.

The EWP Membership is given free of charge and may be accorded to the following persons:-

  1. New Purchasers who have executed the Principal SPA and have paid ten per-cent (10%) of the purchase price stated in the Principal SPA; and
  2. Sub-Sale Purchasers.

For the application of the EWP Membership, the New Purchasers and/or Sub-Sale Purchasers shall:-

  1. complete the PDP Clause and the Eco World membership form to be endorsed by Eco World and Eco World shall establish the EWP Account for the said New Purchasers and/or Sub-Sale Purchasers;
  2. Sub-Sale Purchasers shall complete the PDP Clause and submit a copy of the duly stamped sale and purchase agreement evidencing their purchase of the Eco World Property(ies) (“Sub-Sale Agreement”);
  3. such other documents as may be required by Eco World from time to time; and
  4. the New-Purchasers and/or Sub-Sale Purchasers shall open a bank account at the nearest participating Alliance Bank branch by furnishing them with the completed and duly endorsed Eco World membership form. For the avoidance of doubt, the EWP Account and the bank account to be maintained with Alliance Bank, if any, are separate and distinct.

Validity of EWP Membership:-

  1. shall at all times subject to the completion of the Principal SPA and compliance of the Terms and Conditions; and
  2. in the event a New Member absolutely assigns/transfers its beneficial/legal rights under the Principal SPA to any third party pending completion of the Principal SPA, the EWP Membership may be revoked at the discretion of Eco World and the consequences of Clause 3.10 shall apply.
  3. the Sub-Sale Members shall complete the Sub-Sale Agreement, i.e. the full purchase price stated therein has been fully settled by the said Sub-Sale Member AND shall within five (5) months from the date of the Sub-Sale Agreement or such other period as may be agreed by Eco World, furnish to Eco World:-
    1. a certified true copy of the individual title/strata title duly registered in favour of the Sub-Sale Member; OR
    2. for transactions pending issuance of individual title/strata title, the relevant prescribed statutory notice of assignment duly served on Eco World, failing which the consequences of Clause 3.10 shall apply.

EWP Membership may be accorded individually to New Purchasers who jointly purchase Eco World Property(ies) under one Principal SPA.

Notwithstanding anything to the contrary contained herein, EWP Membership may be accorded to New Purchasers and Sub-Sale Purchasers even though the purchase price stated in the Principal SPA or the Sub-Sale Agreement, as the case may be, is below RM400,000.00.

For corporate purchasers, EWP Membership shall be accorded under the personal name(s) of the director(s) who has executed the Principal SPA on behalf of the corporate entity unless as otherwise provided in the Board of Director’s resolution of the corporate purchaser which shall be furnished to Eco World upon execution of the Principal SPA. Any request and/or receipt of a corporate entity’s Board of Director’s resolution in respect of the accordance of the EWP Membership to the alternative director(s) of such corporate entity after the execution of the Principal SPA shall not be entertained.

The EWP Membership is non-transferable and non-assignable and is only for the exclusive use of the EWP Participants.

The EWP Membership shall be terminated automatically with immediate effect without prior notice to the EWP Participants in the event:-

  1. the Principal SPA or Sub-Sale Agreement is terminated, rescinded and/or aborted for any reason whatsoever; and/or
  2. the New Purchaser/New Member is eventually not party in the Principal SPA; and/or
  3. termination and/or suspension of the EWP pursuant to Clause 2.1 and/or Clause 3.1; and/or
  4. the New Purchasers/Sub-Sale Purchasers/EWP Participants’ in exercising their right to revoke the PDP Clause; and/or
  5. breach of the Terms and Conditions; and/or
  6. the conduct of such EWP Participants, howsoever caused, whether directly or indirectly, in the opinion of Eco World, deemed unethical, immoral, illegal, offensive or give rise to reasonable cause of complaint from the other EWP Participants or brings disrepute to Eco World and/or the EWP.

Upon such termination, EWP Participants shall no longer be eligible and/or entitled to the EWP Rewards and Eco World shall have no obligation to extend the EWP Rewards to the EWP Participants. The EWP Participants shall at its own cost and expense, return the EWP Card to Alliance Bank and/or the Membership Card, if issued, to Eco World for cancellation. Eco World shall not be responsible or liable for any actions, proceedings, claims, demands, costs, losses and/or expenses whatsoever and howsoever incurred and/or suffered including any third party claims that may be instituted against the EWP Participants and/or Alliance Bank in the event of the stipulated termination.

EWP Rewards

The ELR

  1. Conditions for the ELR entitlement includes but not limited to the following:
    1. applies only to ELR Participants;
    2. applies only to Eco World Property(ies) purchased directly from Eco World;
    3. ELR Participants shall at all times be a party in the sale and purchase agreement entered between Eco World and the said ELR Participants;
    4. ELR Participants shall not be in default of the Terms and Conditions and if applicable the Principal SPA; and
    5. EWP Membership of ELR Participants are to remain valid at all times.
  2. ELR Participants whether purchasing alone or with another ELR Participant shall only be entitled to the ELR not exceeding 2% of the purchase price stipulated in the sale and purchase agreement to be entered with Eco World of an Eco World Property(ies).
  3. ELR Participant shall be entitled to the ELR for transactions where the ELR Participant enters into a sale and purchase agreement together with a New Purchaser and/or Sub-Sale Member for a joint purchase of any Eco World Property(ies) directly from Eco World.
  4. Eco World may at its absolute discretion from time to time without prior notice review or vary the ELR and/or the ELR conditions.
  5. Sub-Sale Purchasers and Sub-Sale Members are not eligible for the ELR on their first purchase of Eco World Property(ies) directly from Eco World. Sub-Sale Purchasers and Sub-Sale Members shall be accordingly termed as New Members and/or Members, as the case may be, upon their first purchase of Eco World Property(ies) directly from Eco World subject to compliance of Terms and Conditions and thereafter shall be eligible to the ELR.
  6. The ELR entitled and/or the ELR redeemed/utilised shall immediately cease to be valid and shall be rendered null and void in the event:-
    1. ai. ELR Participant has entered into the Principal SPA and has made a claim for the redemption of the ELR on the said ELR Participant’s subsequent purchase of Eco World Property(ies) directly from Eco World and thereafter the Principal SPA is terminated and/or aborted for any reason whatsoever; and/or
    2. aii. ELR Participant has entered into the Principal SPA and has made a claim for the redemption of the ELR on the said ELR Participant’s subsequent purchase of Eco World Property(ies) directly from Eco World and thereafter the said subsequent purchase is terminated and/or aborted for any reason whatsoever; and/or
    3. aiii. the ELR Participant defaults on the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions.
  7. Upon the occurrence of any of the above, the following shall apply:-
    1. bi.the said ELR Participant and if applicable, together with any joint ELR Participant/New Purchaser/New Member/Sub-Sale Purchaser/Sub-Sale Member (the parties stated herein shall collectively referred to as the “Defaulting Parties”) shall be liable to repay/refund the monies equivalent to the amount of ELR redeemed/utilised to Eco World immediately upon notification thereof together with any late payment interest and/or administrative fees thereon together with any costs or expenses whatsoever and howsoever incurred/suffered by Eco World;
    2. bii.Eco World shall have the right and the Defaulting Parties agree and irrevocably and unconditionally authorise Eco World to deduct the monies equivalent to the ELR redeemed/utilised together with any late payment interest and/or administrative fees and/or cost or expenses whatsoever and howsoever incurred/suffered by Eco World from the purchase price to be refunded to the said Defaulting Parties pursuant to the said Principal SPA and/or any relevant sale and purchase agreement, as the case may be; and
    3. biii.If the amount equivalent to the ELR or any amount remaining thereto including any cost or expenses whatsoever and howsoever incurred/suffered by Eco World shall remain unpaid after its notification thereof, Eco World reserves the right to make a claim for the same directly from any of the Defaulting Parties as a debt due to Eco World without prejudice to any other rights which Eco World may have.

The EIP

  1. The EIP is worth 1% of the purchase price stipulated in the sale and purchase agreement entered between the Introduced Purchaser and Eco World and such amount equals the same number of points. These points may be accumulated and subsequently utilized as a rebate on the EIP Participant’s next purchase from Eco World Property(ies) directly from Eco World, through a conversion of 1 reward point to RM1.00.
  2. Conditions for the EIP entitlement includes but not limited to the following:-
    1. applies only to the EIP Participants;
    2. applies only to Eco World Property(ies) directly from Eco World;
    3. both the EIP Participant and the Introduced Purchaser shall be required to be present at the relevant Privilege Branches and/or the Introduced Purchaser shall execute a nomination form in favour of an EIP Participant;
    4. a valid EWP Card and/or Membership Card together with the NRICs of the EIP Participant and the Introduced Purchaser together with the EIP form shall be given to the sales personnel of Eco World; and
    5. the Introduced Purchaser shall have executed the PDP Clause and the sale and purchase agreement with Eco World AND
      1. aa.applicable to all Eco World Property(ies), for transactions without the assistance of any loan facilities, the Introduced Purchaser shall have paid not less than 20% of the purchase price stated in the said sale and purchase agreement; OR
      2. bb.applicable to Eco World Property(ies) Penang, Selangor and Kuala Lumpur, for transactions to be partly financed by loan facilities:-
        1. bb1.applicable to land parcels or low rise buildings, i.e. building with three floors or less, the Introduced Purchaser’s financier shall have disbursed part of the loan amount to Eco World towards the settlement of the purchase price stated in the said sale and purchase agreement; OR
        2. bb2.applicable to apartments or multi storey buildings, i.e. building with four floors or more, the Introduced Purchaser’s financier shall have forwarded and Eco World shall be in receipt of a letter of undertaking addressed to Eco World to inter alia, disburse the loan amount or any part thereof to Eco World and/or the master charge, if any, of which shall be in the form acceptable and agreeable to Eco World.
      3. cc.applicable to Eco World Property(ies) Johor, for transactions to be partly financed by loan facilities, the Introduced Purchaser’s financier shall have disbursed part of the loan amount to Eco World towards the settlement of the purchase price stated in the said sale and purchase agreement.
    6. the Principal SPA entered between Eco World and the EIP Participant and the Principal SPA entered between Eco World and the Introduced Purchaser shall at all times remain valid and enforceable; and
    7. EWP Membership of EIP Participants shall all times remain valid.
  3. Subject always to the Terms and Conditions and notwithstanding the fulfilment of the EIP conditions, the EIP shall be granted and/or credited in favour of the EIP Participants in the manner and time as may be decided at the absolute discretion of Eco World. EIP Participants shall have no claims whatsoever and howsoever against Eco World in any matter relating to the EIP and Eco World shall not be under any obligation to grant the EIP and/or extend any form of compensation in place of the EIP granted in any form whatsoever and shall not be liable for such claims.
  4. EIP Participants when purchasing together with a New Purchaser and/or Sub-Sale Member and/or Sub-Sale Purchaser shall not be entitled to the EIP.
  5. For the avoidance of doubt, a Sub Sale Member shall not be termed as an Introduced Purchaser in relation to the EIP.
  6. The EIP is valid for 3 years from the date of the sale and purchase agreement executed by the Introduced Purchaser or such period as may be determined by Eco World at its absolute discretion.
  7. The EIP accumulated by EIP Participants are not transferable save and except for the transfer to the Immediate Family, regardless of the membership status of the said Immediate Family, by submitting to Eco World the following:-
    1. the duly completed EIP Transfer Form and duly acknowledged PDP Clause by the EIP Recipient, if applicable;
    2. a copy each of the EIP Recipient’s and the EIP Transferor’s NRIC;
    3. a copy of the EIP Transferor’s EWP Card and/or Membership Card; and
    4. documentary evidence establishing the relationship of the EIP Recipient’s and the EIP Transferor’s, i.e. birth certificate, marriage certificate, adoption certificate, etc.
  8. The transferred EIP shall only be redeemed in exchange for a rebate on the purchase of Eco World Property(ies) directly from Eco World by the EIP Recipient. The EIP can be transferred at anytime prior to the execution of the sale and purchase agreement between Eco World and the EIP Recipient and at least two (2) months prior to the expiry of the EIP. EIP gained via a transfer from another EIP Participant are subject to the original expiry date. Any unused and expired EIP are strictly not allowed to be reinstated and any requests for such reinstatement will not be entertained. Eco World shall not be responsible and/or liable for all claims, actions, proceedings, costs, expenses, demands and/or losses of whatsoever nature that may howsoever arise, incurred and/or suffered by the EIP Participants and/or the EIP Transferor and/or the EIP Recipient in any way in relation to the transfer of EIP vide the EIP Transfer Form.
  9. In the event where the EIP has been transferred/redeemed/utilised by the EIP Transferor or the EIP Recipient or the EIP Participant, as the case may be, and subsequently the sale and purchase agreement entered between Eco World and the said EIP Recipient or the EIP Participant is cancelled or terminated or the transferred EIP is subsequently not redeemed and/or utilised by the EIP Recipient, the said EIP shall not be reinstated in favour of the EIP Transferor and/or the EIP Participant.
  10. The entitlement to the EIP, the EIP accumulated by the EIP Participant and/or the EIP rewarded/redeemed/utilised/transferred by the EIP Participant or the EIP Transferor or the EIP Recipient, as the case may be, shall be rendered null and void and shall immediately cease to be valid in the event:-
    1. ai.EIP Participant has entered into the Principal SPA and has made a claim for the redemption of any EIP accumulated on the said EIP Participant’s subsequent purchase of Eco World Property(ies) directly from Eco World and thereafter the Principal SPA is terminated and/or aborted for any reason whatsoever; or
    2. aii.EIP Participant has entered into the Principal SPA and has made a claim for the redemption of any EIP accumulated on the said EIP Participant’s subsequent purchase of Eco World Property(ies) directly from Eco World and thereafter the said subsequent purchase is terminated and/or aborted for any reason whatsoever; or
    3. aiii.EIP Transferor has made a transfer of any EIP accumulated to an EIP Recipient for the said EIP Recipient’s redemption of the transferred EIP on the said EIP Recipient’s purchase of an Eco World Property(ies) directly from Eco World and thereafter the Principal SPA entered with the EIP Transferor is terminated and/or aborted for any reason whatsoever OR the sale and purchase agreement entered with the EIP Recipient is terminated and/or aborted for any reason whatsoever; or
    4. aiv.the EIP Participant and/or EIP Recipient defaults on the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions; or
    5. av.the Introduced Purchaser defaults on the said Introduced Purchaser’s Principal SPA before or after the fulfilment of the EIP Conditions; or
    6. avi.any of the EIP Conditions are not satisfied or subsequently breached by the EIP Participant and/or Introduced Purchaser, as the case may be.
  11. Upon the occurrence of the above, the following shall apply:-
    1. bi.The amount equivalent to the EIP awarded/redeemed/utilised shall immediately be a debt due to Eco World and the EIP Participant and/or EIP Transferor and/or EIP Recipient and/or Introduced Purchaser, as the case may be, shall be liable to repay/refund the monies equivalent to the said amount of the EIP awarded/redeemed/utilised to Eco World immediately upon notification thereof together with any late payment interest and/or administrative fees thereon and/or cost or expenses whatsoever and howsoever incurred/suffered; and/or
    2. bii.Eco World shall have the right and the EIP Participant and/or EIP Transferor and/or EIP Recipient and/or Introduced Purchaser, as the case may be, agree and irrevocably and unconditionally authorise Eco World to deduct the monies equivalent to the amount of the EIP awarded/redeemed/utilised together with any late payment interest and/or administrative fees and/or any costs and expenses whatsoever and howsoever incurred/suffered by Eco World from the purchase price to be refunded to the EIP Participant and/or EIP Transferor and/or EIP Recipient and/or Introduced Purchaser, as the case may be, pursuant to the Principal SPA and/or any relevant sale and purchase agreement, as the case may be, entered between Eco World and the EIP Participant and/or EIP Transferor and/or EIP Recipient and/or Introduced Purchaser, as the case may be; and/or
    3. biii.If the amount equivalent to the EIP or any amount remaining thereto including any cost or expenses whatsoever and howsoever incurred/suffered by Eco World shall remain unpaid after its notification thereof, Eco World reserves the right to make a claim for the same directly from the said EIP Participant and/or EIP Transferor and/or EIP Recipient and/or Introduced Purchaser, as the case may be, without prejudice to any other rights which Eco World may have; and/or
    4. biv.the EIP shall be revoked and/or the EIP shall not be rewarded or reinstated in favour of the EIP Participant and/or the EIP Transferor and/or the EIP Recipient, as the case may be.
  12. Nothing herein contained shall prevent Eco World to withhold and/or to grant the EIP in the manner and time at the sole and absolute discretion of Eco World.
  13. Eco World may at its absolute discretion from time to time without prior notice review or vary the EIP and/or the EIP conditions.

The entitlement for the EWP Rewards shall be determined at the point of purchase by the respective Privilege Branches.

The EWP Rewards when used/redeemed/utilised collectively shall not exceed 10% of the purchase price in the sale and purchase agreement to be entered with Eco World and shall be used/redeemed/utilised to off-set only against the first 10% of the purchase price of the said sale and purchase agreement.

The EWP Rewards cannot be exchanged for cash unless specified otherwise by Eco World at its absolute discretion.

Eco World reserves the right without prior notice to cancel, suspend, terminate or otherwise change the EWP Rewards without assigning any reasons. Upon such cancellation, suspension, termination or changes, Eco World shall not be under any obligation to extend the EWP Rewards to the EWP Participants. Any substitution or variation by Eco World of any privileges contained herein shall not entitle the EWP Participants to any claims or compensation from Eco World for any losses or damages whatsoever and howsoever suffered or incurred by the EWP Participants whether directly or indirectly.

Eco World reserves the right to reduce or terminate the number, value, or the expiry period of any of the EWP Rewards, without further reference to the EWP Participants.

Any request for the redemption/utilization/transfer (if allowed) of any of the EWP Rewards shall be made vide the duly completed forms and to be approved by Eco World.

The reward/redemption/utilization/transfer (if allowed) of any of the EWP Rewards shall at all times subject to the validity of the EWP Membership, the approval of Eco World and the compliance of the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions.

Eco World reserves the right at any time without prior notice and without assigning any reason thereto to withdraw, withhold, suspend, cancel, reject any request or the approval of the redemption/utilization/transfer (if allowed) of any of the EWP Rewards.

The EWP Rewards are distinct privileges offered only to EWP Participants and shall not be used with any other benefits and/or privileges offered and/or promoted by Alliance Bank.

Eco World may at any time introduce other related privileges/benefits in place or in addition to the ELR and EIP and the conditions attached thereto as may be decided at the absolute discretion of Eco World.

Personal Data Protection Act

In consideration of the EWP Participants’ provision of their Personal Data to Eco World vide the PDP Clause, the New Purchasers/Sub-Sale Purchasers/EWP Participants acknowledges, confirms and consents to Eco World collecting, recording, holding, storing, using, dealing with and otherwise processing such Personal Data for the purposes stated therein including services for the enhancement and support of the relationship of the EWP Participants and Eco World and post vacant possession services, i.e. customer loyalty programmes, vide the EWP.

In connection with the purposes above, Eco World is thereby permitted to:-

  1. process the Personal Data in all matters relating to the EWP including but not limited to the application for EWP Membership, issuance of the Membership Card, maintaining the EWP Account, any application for the EWP Rewards together with any other matter relating thereto, and providing information, promotional and marketing materials regarding the EWP; and
  2. disclose the Personal Data to Alliance Bank for the issuance of the EWP Card, to relevant government authorities or third parties where required by law or for legal purposes or deemed necessary pursuant to the Personal Data Protection Act 2010.

Where Personal Data is requested the New Purchasers/Sub-Sale Purchasers/EWP Participants has the option not to provide additional information requested other than the information which Eco World has indicated as necessary to facilitate any matters relating to the EWP. In the event insufficient Personal Data and/or any additional information is not provided, Eco World may not be able to offer the EWP Membership and/or the EWP Rewards to the concerned EWP Participants of which Eco World shall not be responsible for any liability to damages, costs, expenses and/or losses whatsoever and howsoever incurred and/or suffered by the concerned EWP Participants.

EWP Participants shall notify Eco World in writing if any change in any Personal Data provided and may request in writing for access to and to request for correction of Personal Data in accordance with the Personal Data Protection Act 2010 including those stipulated in the PDP Clause including any variation thereof.

General

The EWP Rewards are not valid for use with other ongoing Eco World promotions and discounts unless otherwise decided at the absolute discretion of Eco World.

In case of any dispute, investigation, verification, validation, determination and all other matters whatsoever and howsoever arises in relation to the EWP, the EWP Membership, the EWP Rewards and/or the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions, the decision of Eco World shall be final and conclusive.

Eco World shall not in any circumstances be liable for any loss or damage including loss of reputation or embarrassment whatsoever and howsoever suffered/incurred by EWP Participants due to any of the following reasons but not limited to: -

  1. any unauthorised use of the EWP Card and/or Membership Card;
  2. any failure by an EWP Participant to notify Eco World of any of the EWP Rewards applicable for a transaction;
  3. any EWP Rewards and/or privileges offered and/or promoted by Eco World and/or Alliance Bank not being available for any reason whatsoever;
  4. any omission by Eco World to notify EWP Participants of any changes in the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions;
  5. any failure due to whatsoever reason by an EWP Participant of their request and/or approval to redeem/utilize/transfer of the EWP Rewards;
  6. the variation and/or suspension and/or termination of the EWP and/or collaborative efforts between Eco World and Alliance Bank in respect of the EWP including the termination and/or cancelation of the EWP Card issued by Alliance Bank;
  7. any failure by an EWP Participant to notify Eco World of any change of Personal Data provided to Eco World; and/or
  8. any exercise of discretion by Eco World in any matter relating to the EWP, the EWP Membership and the EWP Rewards.

Eco World reserves the right without prior notice and without assigning any reasons thereto to decline the issuance of or to withdraw the EWP Card and/or Membership Card at any time or terminate the EWP Membership as and when necessary.

The minimum purchase price of RM400,000.00 whenever mentioned in the Terms and Conditions shall also mean the minimum purchase price of RM400,000.00 after deduction of any Bumiputra discounts.

Any request for a replacement of the Membership Card for any reason shall be made directly with the Privilege Branches subject to an administrative fee as may be determined at the sole and absolute discretion of Eco World.

Employees of Eco World and their parents, spouses and children are not eligible to participate in the EWP.

The EWP is not applicable to overseas projects and/or non-participating properties of Eco World, as may be decided at the sole and absolute discretion of Eco World.

EWP Participants are deemed to have accepted and agreed to be bound by the Terms and Conditions upon making an application for the EWP Membership or upon making an application for redemption for the EWP Rewards or upon participating and/or accepting any of the EWP Rewards.

Eco World reserves the right without prior notice to add, modify, delete or amend the Terms and Conditions, including any variation to the condition and/or value of the EWP Rewards at any time.

EWP Participants who do not wish to be bound by the Terms and Conditions including any variation thereto shall immediately return the EWP Card to Alliance Bank and/or the Membership Card to Eco World for cancellation purposes AND shall surrender all of the EWP Rewards AND shall not participate or accept any of the EWP Rewards.

EWP Participants shall at all times comply with all requirements, directions, instructions and guidelines issued by Eco World from time to time in respect of EWP.

Without prejudice to any other remedies available to Eco World, any legal fees (on a solicitor and client basis) and other costs and expenses whatsoever and howsoever incurred by Eco World in the enforcement of Eco World’s rights and entitlement under the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions and the recovery of monies owed by the EWP Participants, in relation to the EWP Membership and/or the EWP Rewards shall be fully borne by the EWP Participants.

Eco World’s rights and entitlement under the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions shall continue to remain in full force and shall survive notwithstanding any cancelation, termination, revocation or suspension of the EWP Membership and/or EWP Card and/or Membership Card and/or the EWP herein contained.

For the avoidance of doubt, in the event of the EWP Membership is invalidated, terminated and/or revoked for whatsoever reason and/or in accordance to the Terms and Conditions including any directives and/or terms and conditions ancillary to and/or in addition to the Terms and Conditions, physical possession of the EWP Card and/or the Membership Card held by any of the EWP Participant and/or such persons shall not accord to such EWP Participant and/or such persons any right or claim to, and Eco World shall have no obligation to reward to such EWP Participant and/or such persons to, any of the EWP Rewards.

For the avoidance of doubt, EWP Participants does not and shall not perform and/or act as agent and/or assume the duty and/or responsibility of Eco World in relation to the administration and operation of the EWP and shall not have any authority whatsoever to bind Eco World in any manner howsoever.
