Governing Law and Jurisdiction

The terms and conditions herein shall be governed by and construed in accordance with the laws of Malaysia and you shall submit to the jurisdiction of the courts of Malaysia.

This Privacy Notice outlines how Eco World Development Group Berhad, its subsidiaries, related corporations, associated companies, affiliates and joint venture companies as well as their representatives (collectively, “EcoWorld”) collect, use, disclose and process your Personal Data in respect of transactions with EcoWorld.
For the purpose of this Privacy Notice, the terms “we”, “our” and “us” shall refer to any company or representative within EcoWorld and the terms “you” and “your” shall refer to yourself and/or such other persons or companies represented by you of which you are providing Personal Data.
In this Privacy Notice, “Personal Data”, “collect”, “use”, “disclose” and “process” shall have the same meanings as defined in the Personal Data Protection Act 2010 [Act 709] (“PDPA”) (as may be amended from time to time) and its corresponding regulations, standards, guidelines, notices and/or practices issued thereunder.
Such Personal Data which you may provide or make available to EcoWorld include information concerning your personal details (such as name, identity card number, passport number, date of birth, age, gender, race, nationality), contact details and any other relevant information that you have disclosed to EcoWorld depending on the nature of dealings or transactions (as may be updated from time to time).
In the course of your dealings with EcoWorld, you may have furnished your Personal Data to EcoWorld and in doing so, you acknowledge and confirm that you are providing to us accurate, complete, not misleading and up-to-date Personal Data and further agree and consent to EcoWorld collecting, using, disclosing, processing and retaining your Personal Data. EcoWorld, its officers and/or employees shall not be liable for any inaccurate, incomplete, misleading or not up-to-date Personal Data provided by you.
In the event you furnish or make available to EcoWorld any Personal Data relating to a third party, e.g. information of spouse, children, parents, directors, shareholders and/or guarantors (collectively the “Relevant Persons”), you represent and warrant that you have obtained the consent of the Relevant Persons for you to provide EcoWorld with their Personal Data, which are accurate, complete, not misleading and up-to-date; and for EcoWorld to collect, use, disclose, process and retain their Personal Data for the relevant purposes.
Notwithstanding the foregoing, EcoWorld is not required to verify the accuracy and completeness of the Personal Data provided by you and EcoWorld is entitled to treat the Personal Data provided by you as accurate, complete, not misleading and up-to-date.
EcoWorld collects your Personal Data in various ways, in printed or electronic forms through digital and mobile platforms, such as:
1. when you / your representatives register or update an online profile or when you / your representatives complete or update your information with EcoWorld;
2. when you / your representatives / employers submit completed forms, applications (including job applications) and/or documents to EcoWorld;
3. when you enter into any transaction with EcoWorld;
4. when you make payment related to any transaction with EcoWorld;
5. when you / your representatives communicate with EcoWorld’s employees;
6. when you visit our premises in person, e.g. sales galleries, offices or show units, through security or CCTV recordings;
7. from your personalised preference through the use of EcoWorld’s website, social media accounts, mobile platforms operated or managed by EcoWorld;
8. when you participate in EcoWorld’s contests, events, market research and surveys;
9. from information obtained independently by EcoWorld from other lawful sources; and
10. other purposes where you have provided us with information.
EcoWorld may collect, use, disclose, process and retain your Personal Data for the following purposes:
1. considering and processing your application for and providing you with products and/or services of EcoWorld as well as products and/or services by third party service providers provided through EcoWorld;
2. facilitating, implementing and/or formalising any transaction with EcoWorld;
3. processing any payments related to any transaction with EcoWorld;
4. communicating with you including responding to queries, requests and/or complaints;
5. facilitating EcoWorld’s customers loyalty programmes, customer relations events and activities;
6. updating your Personal Data;
7. facilitating your participation in EcoWorld’s contests and events;
8. conducting market research and surveys with the aim of improving EcoWorld’s products and /or services;
9. *providing you marketing, advertising and promotional information about other products / services that EcoWorld, its business partners or third party service providers may be offering (“Marketing Information”), by way of postal mail to your address(es) and/or electronic transmission to your email address(es), text messages (SMS/MMS), telephone calls and/or other phone based messaging to your telephone number(s);
10. conducting credit / trade checks and other background checks on you and where applicable, any Relevant Persons with any registered credit reporting Updated 21 February 2024 agency at any time for the purpose of processing a transaction with EcoWorld or for as long as any dues remain unpaid and outstanding with EcoWorld;
11. for the purpose of credit evaluation, review or reporting and carrying out debt-collection or assisting other institutions to do so;
12. prevention and detection of crime including without limitation to money laundering, terrorism and fraud prevention, detection and prosecution;
13. required by government authorities or otherwise in compliance with laws, rules, regulations, by-laws, orders, guidelines and/or directives issued by the relevant authorities;
14. enforcing EcoWorld’s legal rights and/or obtaining legal advice;
15. facilitating any transaction with EcoWorld, which may include opening of utility accounts, registering ownership, and managing and maintaining of common property;
16. facilitating business transactions which may include mergers, acquisitions or asset sales;
17. compliance with internal policies and procedures, including without limitation, risk management, product planning, insurance, audit and other administrative purposes;
18. for all ancillary purposes relating to the provision of facilities including the provision of computer, telecommunications and technology services;
19. human resource applications; and/or
20. any other incidental purpose relating to any of the above or any transaction with EcoWorld.*Where you have consented to receiving Marketing Information and/or sharing your Personal Data with third parties for the purpose of Marketing Information, you may opt-out of receiving such Marketing Information or sharing of your Personal Data with third parties for the aforesaid purpose by contacting EcoWorld in accordance with Section 15.
For the purposes as set out in Section 9, your Personal Data may/will be disclosed to the following parties:
1. any company or representative within EcoWorld;
2. EcoWorld’s third party service providers or agents (including without limitation auditors, lawyers, consultants, insurers, adjusters and utility companies);
3. any registered credit reporting agencies under the Credit Reporting Agency Act 2010 [Act 710];
4. EcoWorld’s business partners, professional advisers, investors, assignees or transferees to facilitate business asset transactions (including without limitation to any merger, acquisition or asset sale);
5. any law enforcement agencies;
6. any governmental authorities or regulatory bodies; and
7. any other party authorised and consented by you.
EcoWorld may disclose your Personal Data to any or all of the parties stated above which may be located within or outside of Malaysia or involve sending your Personal Data to a location outside of Malaysia.
EcoWorld takes the necessary precautions, both administrative and technical, to safeguard your Personal Data against loss, theft, misuse and unauthorised access, disclosure, usage, alteration or destruction.
You may, subject to a payment of a prescribed fee, any applicable legal restrictions and/or contractual conditions, request in writing for access to or a copy of your Personal Data.
We request that you ensure the Personal Data provided to us is accurate, complete, not misleading and up-to-date.

In the event we are unable to comply with your data access request or data correction request, we will inform you accordingly by written notice.
You have an option not to provide the additional Personal Data requested by EcoWorld other than the information which is indicated as necessary to facilitate the transaction. If insufficient Personal Data is provided or your consent or the consent of any Relevant Person given herein is withdrawn, or your Personal Data or the Personal Data of any Relevant Person is deleted, EcoWorld may not be able to continue our relationship with you, provide you with its products and services and/or fulfil any of your request to EcoWorld or you may not be able to access or use some of the functionality of our website or mobile platforms.
EcoWorld reserves the right to update and amend this Privacy Notice from time to time. Any material changes will be notified to you via the email address that you Updated 21 February 2024 have provided or the updated Privacy Notice shall be posted on our website. Where required by applicable data protection laws we will obtain your consent to such changes.
In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Privacy Notice, the English version shall prevail.

Notis Privasi ini menyatakan cara Eco World Development Group Berhad, anak syarikat, syarikat berkaitan, syarikat bersekutu, syarikat gabungan dan usahasama serta wakil mereka (secara kolektif, “EcoWorld”) mengumpul, menggunakan, mendedahkan dan memproses Data Peribadi anda berkenaan transaksi dengan EcoWorld.
Untuk tujuan Notis Privasi ini, terma “kami” merujuk kepada mana-mana syarikat atau wakil dalam EcoWorld dan terma “anda” merujuk kepada anda dan/atau individu lain atau syarikat yang anda wakili dan memberi maklumat Data Peribadi.
Dalam Notis Privasi ini, “Data Peribadi”, “mengumpul”, “menggunakan”, “mendedahkan” dan “pemprosesan” mempunyai maksud yang sama seperti yang ditakrifkan dalam Akta Perlindungan Data Peribadi 2010 [Akta 709] (seperti yang dipinda dari semasa ke semasa) dan peraturan, piawaian, garis panduan, notis dan/atau amalan yang dikeluarkan di bawah akta tersebut.

Sepanjang masa anda berurusan dengan EcoWorld, anda mungkin telah membekalkan Data Peribadi anda kepada EcoWorld dan dengan berbuat demikian, anda mengakui dan mengesahkan bahawa Data Peribadi yang dibekalkan adalah tepat, lengkap, tidak mengelirukan dan terkini dan seterusnya bersetuju dan membenarkan EcoWorld untuk mengumpul, mengguna, mendedahkan, memproses dan menyimpan Data Peribadi anda. EcoWorld, pegawainya dan/atau pekerjanya tidak akan bertanggungjawab atas sebarang Data Peribadi yang tidak tepat, tidak lengkap, mengelirukan atau tidak terkini yang dibekalkan oleh anda.
Sekiranya anda membekalkan atau memberikan kepada EcoWorld sebarang Data Peribadi yang berkaitan dengan pihak ketiga, cth. maklumat pasangan, anak, ibu bapa, pengarah, pemegang saham dan/atau penjamin (secara kolektif “Orang Berkenaan”) anda mewakili dan menjamin bahawa anda telah memperolehi persetujuan daripada Orang Berkenaan untuk memberikan Data Peribadi mereka kepada EcoWorld dengan tepat, lengkap, tidak mengelirukan dan terkini dan untuk EcoWorld mengumpul, mengguna, mendedah, memproses dan menyimpan Data Peribadi mereka untuk tujuan berkenaan.
Walau bagaimanapun, EcoWorld tidak perlu membuat pengesahan terhadap kesahihan dan kesempurnaan Data Peribadi yang anda bekalkan dan EcoWorld Dipinda 21 Februari 2024 berhak untuk menganggap Data Peribadi yang dibekalkan oleh anda adalah tepat, lengkap, tidak mengelirukan dan terkini.
EcoWorld mengumpul Data Peribadi anda dalam pelbagai cara, dalam bentuk bercetak atau elektronik melalui platform digital dan mudah alih, seperti:
1. apabila anda / wakil anda mendaftar atau mengemas kini profil dalam talian atau apabila anda / wakil anda melengkapkan atau mengemas kini maklumat anda dengan EcoWorld;
2. apabila anda / wakil anda / majikan anda menyerahkan borang yang dilengkapkan, permohonan (termasuk permohonan kerja) dan/atau dokumen kepada EcoWorld;
3. apabila anda membuat sebarang transaksi dengan EcoWorld;
4. apabila anda membuat pembayaran yang berkaitan dengan sebarang transaksi dengan EcoWorld;
5. apabila anda / wakil anda berkomunikasi dengan pekerja EcoWorld;
6. apabila anda mengunjungi premis kami, cth. galeri jualan, pejabat, atau unit pameran, melalui sekuriti atau rakaman CCTV;
7. melalui pilihan peribadi anda semasa melayari laman web EcoWorld, akaun media social, platform mudah alih yang dikendalikan atau diuruskan oleh EcoWorld;
8. apabila anda menyertai peraduan, acara, penyelidikan pasaran dan kajiselidik EcoWorld;
9. daripada maklumat yang diperoleh oleh EcoWorld secara persendirian daripada sumber-sumber yang sah; dan
10. tujuan lain di mana anda telah bekalkan maklumat kepada kami.
EcoWorld boleh mengumpul, mengguna, mendedahkan, memproses dan menyimpan Data Peribadi anda untuk tujuan berikut:
1. mempertimbangkan dan memproses permohonan anda untuk memberikan anda produk dan/atau perkhidmatan EcoWorld serta produk dan/atau perkhidmatan oleh pembekal-pembekal perkhidmatan pihak ketiga yang diberikan melalui EcoWorld;
2. memudahcara, melaksanakan dan/atau memformalkan sebarang transaksi dengan EcoWorld;
3. memproses sebarang bayaran yang berkaitan dengan sebarang transaksi dengan EcoWorld;
4. berkomunikasi dengan anda termasuk menjawab pertanyaan, permintaan dan/atau aduan;
5. memudahcara program kesetiaan pelanggan EcoWorld, acara dan aktiviti perhubungan pelanggan;
6. mengemas kini Data Peribadi anda;
7. memudahcara penyertaan anda dalam peraduan dan acara EcoWorld;
8. menjalankan penyelidikan dan tinjauan pasaran dengan tujuan untuk menambah baik produk dan/atau perkhidmatan EcoWorld;
9. *menghantar maklumat pemasaran, pengiklanan dan promosi tentang produk/perkhidmatan lain yang mungkin ditawarkan oleh EcoWorld, rakan kongsi perniagaannya atau pembekal perkhidmatan pihak ketiga (“Maklumat Pemasaran”) kepada anda, melalui pos ke alamat anda dan/atau penghantaran elektronik ke alamat e-mel anda, mesej teks (SMS/MMS), panggilan telefon dan/atau sistem pemesejan telefon lain ke nombor telefon anda;
10. menjalankan semakan kredit/perdagangan dan semakan latar belakang lain ke atas anda dan jika berkenaan, mana-mana Orang Berkenaan dengan mana-mana agensi pelaporan kredit berdaftar pada bila-bila masa untuk tujuan memproses sebarang transaksi dengan EcoWorld atau selagi terdapat apa-apa tunggakan dengan EcoWorld;
11. untuk tujuan penilaian kredit, semakan atau pelaporan dan menjalankan kutipan hutang atau dalam membantu institusi lain berbuat demikian;
12. pencegahan dan pengesanan jenayah termasuk, tanpa terhad kepada pengubahan wang haram, pencegahan keganasan dan penipuan, pengesanan dan pendakwaan;
13. dikehendaki oleh pihak berkuasa Kerajaan atau untuk menurut undang-undang, peraturan, peraturan, undang-undang kecil, perintah, garis panduan dan/atau arahan yang dikeluarkan oleh pihak berkuasa berkenaan;
14. menguatkuasakan hak undang-undang EcoWorld dan/atau mendapatkan nasihat undang-undang;
15. memudahcara sebarang transaksi dengan EcoWorld, mungkin termasuk pembukaan akaun utiliti, mendaftarkan pemilikan, mengurus dan menyenggara harta Bersama;
16. memudahcara transaksi perniagaan termasuk penggabungan, pemerolehan atau penjualan aset;
17. pematuhan kepada dasar dan prosedur dalaman termasuk, tanpa terhad kepada pengurusan risiko, perancangan produk, insurans, audit dan tujuan pentadbiran lain;
18. untuk semua tujuan sampingan yang berkaitan dengan penyediaan kemudahan termasuk penyediaan perkhidmatan komputer, telekomunikasi dan teknologi;
19. aplikasi sumber manusia; dan/atau
20. sebarang tujuan sampingan lain yang berkaitan dengan mana-mana perkara di atas atau sebarang transaksi dengan EcoWorld.*Jika anda telah bersetuju untuk menerima Maklumat Pemasaran dan/atau berkongsi Data Peribadi anda dengan pihak ketiga untuk tujuan Maklumat Pemasaran, anda boleh menarik diri daripada menerima Maklumat Pemasaran tersebut atau perkongsian Data Peribadi anda dengan pihak ketiga untuk tujuan yang disebutkan di atas dengan menghubungi EcoWorld mengikut Seksyen 15.
Untuk tujuan seperti yang dinyatakan dalam Seksyen 9, Data Peribadi anda mungkin/akan didedahkan kepada pihak berikut:
1. mana-mana syarikat atau wakil dalam EcoWorld;
2. pembekal perkhidmatan atau ejen pihak ketiga EcoWorld (termasuk tanpa terhad kepada juruaudit, peguam, perunding, penanggung insurans, penyelaras dan syarikat utiliti);
3. mana-mana agensi pelaporan kredit berdaftar di bawah Akta Agensi Pelaporan Kredit 2010 [Akta 710];
4. rakan kongsi perniagaan, penasihat professional, pelabur, penerima serah hak atau penerima pindahan EcoWorld untuk memudahcara transaksi aset perniagaan (termasuk tanpa terhad kepada sebarang penggabungan, pemerolehan atau penjualan aset);
5. mana-mana agensi penguatkuasaan undang-undang;
6. mana-mana pihak berkuasa kerajaan atau badan pengawalseliaan; dan
7. mana-mana pihak lain yang dibenarkan dan dipersetujui oleh anda.
EcoWorld mungkin mendedahkan Data Peribadi anda kepada mana-mana atau semua pihak yang dinyatakan di atas yang mungkin berada di dalam atau di luar Malaysia atau melibatkan penghantaran Data Peribadi anda ke lokasi di luar Malaysia.
EcoWorld mengambil langkah pencegahan, dari kedua-dua segi pentadbiran dan teknikal, untuk melindungi Data Peribadi anda daripada kehilangan, pencurian, penyalahgunaan, akses tanpa kebenaran, pendedahan, penggunaan, pengubahan atau kemusnahan.
Anda boleh, tertakluk kepada bayaran fi yang ditetapkan, sebarang sekatan undang-undang dan/atau syarat kontrak yang berkenaan, membuat permintaan mengakses Data Peribadi secara bertulis dan untuk sesalinan Data Peribadi anda.
